These Terms and Conditions ("Terms") govern your use of services provided by Rockspire Private Utility Locating Houston ("Company", "We", "Us", or "Our"), operating under The Rockspire Agency LLC, including private utility locating, risk assessments, scheduling, and related communications. By accessing, scheduling, or using any of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, then you may not access or use our services.

Services

Rockspire Private Utility Locating Houston provides professional private utility locating services utilizing advanced electromagnetic (EM) locating technology. Our service is designed to identify and mark accessible metallic underground utilities on your private property to help you dig safely and reduce risk. This service includes on-site marking and a detailed briefing by our technician.

Payments

All service fees are due at the time of booking. Our standard service covers up to 90 minutes of on-site locating. Any time exceeding 90 minutes will be billed at $75 per hour, charged in 15-minute increments. Additional fees apply for Same-Day, Weekend, or After-Hours services as specified during the booking process. Optional add-on services are available for an additional charge.

Refund and Cancellation Policy

Your satisfaction and our operational efficiency are important to us. Please review our refund and cancellation policies carefully:

  • Customer Cancellation: If you cancel your scheduled locate appointment at least **12 hours** prior to the booked time, you will be issued a full refund.
  • Late Customer Cancellation: If you cancel your appointment **within 12 hours** of the booked time, a **$50 service fee** will be retained from your payment or charged.
  • Very Late Customer Cancellation: If you cancel your appointment **within 90 minutes** of the booked time, a **$100 service fee** will be retained from your payment or charged.
  • No-Shows / Customer Not Present: If our technician arrives at the scheduled time and you are not present, or the property is not accessible, you will not be issued a refund for the missed appointment. However, you may reschedule the same service for an **additional $100 re-scheduling fee**.
  • Inability to Locate a Line: Our technicians use their best efforts and advanced EM locating technology to find all accessible metallic utilities. If, despite these efforts, we are unable to locate a specific line, refunds will be issued at our discretion. For instance, if extensive work was performed to locate multiple lines and only one particular line remained unlocatable, a full refund may not be provided. However, if our service was specifically for one line that could not be located, a refund of the service fee minus a $50 service fee (to cover operational costs) may be considered.
  • Company Cancellation: In the rare event that we must cancel your appointment for any reason (e.g., severe weather, unforeseen operational issues), a full refund will be processed promptly.

Completion of Service

Service is considered complete when our technician leaves the property after having performed the requested locate services, provided on-site markings, and delivered the verbal briefing of findings.

Property Owner Responsibility and Liability Disclaimer

By using our service, you acknowledge and agree to the following:

  • Your Responsibility for Safe Digging: Our service provides a professional locate and markings of accessible metallic private utilities. However, it is the **property owner's ultimate responsibility** to exercise extreme caution and follow safe digging practices (e.g., hand digging within tolerance zones) even after lines have been marked.
  • Accuracy of Markings: We strive for the best possible accuracy in our locates using industry-standard EM locating equipment and techniques. However, underground conditions (e.g., soil type, interference, depth variations, non-metallic lines without tracer wires, abandoned lines not on record) can affect precise locating. Our markings are a guide based on the information gathered at the time of service.
  • 811 Call Requirement: Our private utility locating service is separate from and does not replace the requirement to contact 811 (or your local One Call system) for public utility locates. You are legally required to contact 811 at least a few business days before you dig.
  • No Permits Implied: Our service provides utility location information; it does not grant permission to dig or imply that permits are not required for your excavation project. It is your responsibility to obtain all necessary permits from your local municipality before commencing any digging.
  • Your Liability: You, the homeowner or property owner, are almost always held financially and legally responsible for any damages, injuries, or other consequences that result from striking an unmarked private utility line on your property. This liability applies regardless of whether you or a contractor performs the digging. Our service helps to significantly reduce this risk but does not transfer liability.

Limitation of Liability

To the fullest extent permitted by law, Rockspire Private Utility Locating Houston shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to financial losses, personal injury, service interruptions, or project delays, arising from the use of our services or reliance on our markings. Our total liability shall not exceed the amount paid by the client for the specific service from which the claim arises.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law rules. Any legal disputes related to these Terms or our services will be subject to the exclusive jurisdiction of the courts located in Texas.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, operational procedures, or legal obligations. We will notify You of any changes by posting the new Terms and Conditions on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
